terms of service

GENERAL
● Communication is important! If I do not receive a response within one week I will either stop working on the artwork until a response is made or I will proceed and deliver as is depending on where I am in the process.
● AI/NFT use is strictly prohibited. My work may not be used in AI datasets,engines, or minted as NFTs.
● I reserve the right to decline commissions outside of my abilities or for subjects I will not draw.
● By default, commissions are for Personal Use Only. Refer below to information on commercial rights.PAYMENTS, FEES & REFUNDS
● All payments are up front in full through the agreed upon platform. Any other payment schedule must be discussed before the commission has been started and be mutually agreed upon.
● Must be paid in USD. All payments can be accepted through Paypal, Venmo, or Ko-fi.
● I reserve the right to cancel and refund the commission for any reason.
● Once payment is received, refunds are no longer available.
● Rush Fee - + $15
──➤ If you wish to skip the queue and have your commission be placed as priority, you must directly message that you wish for a Rush Fee.
● Custom Design Fee - + $20 to $30
──➤ Custom designs are defined as artwork entirely or partially designed by me, including character redesigns.
● Complexity Fee - + $15 to $25
──➤ Range depends on complexity and will be specified before payment is requested.
● Additional Character Fee - + 50% of original price
● Commercial Rights License - + $60
──➤ Art commissioned with the intent of being profited off of as monetized content or commercial merchandising is subject to a $50 fee. This includes, but is not limited to: physical merchandise, thumbnails, logos and watermarks.REVISIONS
● The commissioner is entitled to unlimited revisions during the sketch phase within reason. After lineart has been started, only minor revisions will be accepted. If the commissioner wishes for a major revision, a revision fee of $10 will be required before I begin working on said revision.
● Errors on my end will always be corrected at no extra cost.DEADLINES & DELIVERY
● The finished art will be delivered to the commissioner through direct messaging on the platform the communication was initiated. The art may also be delivered via email upon request. Physical deliveries such as prints are unavailable.
● Commissions may take up to one month to complete depending on complexity or personal matters.
● Updates regarding delays will always be informed of as soon as possible.ARTIST & COMMISSIONER RIGHTS
● I may use the artwork to promote myself and my services as well as post on social media and in my portfolio.
● You may post the artwork on social media but only with credit to me as "@shotglassofsun".
● You may NOT claim the artwork as your own or fail to credit me, remove the watermark, resell my artwork and designs for higher than what was originally paid, modify the artwork without my consent, or use the artwork commercially without purchasing the Commercial Rights License.FINAL AGREEMENT
● By commissioning me, you acknowledge that you have read, understood, and agreed to everything listed above.

*Age verification required and acquired through photo verification. The commissioner must send an image of their ID card with everything but their date of birth crossed out. Accompanying the image of the ID must be the commissioner's username written on paper.
**Art style mimicry requests must be discussed before I have begun sketching. Some art styles cannot be mimicked.
